Section 7. Termination of apprenticeship contract
(1) The contract terminates on expiry of the training period.
(2) Either party may apply to the Apprenticeship Adviser for termination, sending a copy of the application to the other party.
(3) After considering the application and any objections, the Apprenticeship Adviser may, by written order, terminate the contract if satisfied a party has failed to carry out its terms and termination is desirable.
Proviso: Where terminated for the employer’s failure, he must pay the apprentice prescribed compensation; where terminated for the apprentice’s failure, the apprentice/guardian must refund the employer’s training costs as determined by the Adviser.
(4) Where a contract is terminated before expiry due to the previous employer’s lapse, and a new contract is entered with a new employer, the Apprenticeship Adviser may permit the training period already completed to count toward the new contract.
