102. Persons to be searched may require to be taken before gazetted officer of customs or magistrate
- Before a person is searched under section 100 or 101, he may require the officer to take him before a gazetted officer of customs or a magistrate.
- If such a requisition is made, the officer may detain the person until he can be brought before such gazetted officer or magistrate.
- The gazetted officer or magistrate, if of the view there is no reasonable ground for the search, shall discharge the person; otherwise, he shall direct the search be made.
- Before the search, the officer shall, if the person so requires, call two or more persons to attend and witness the search, and may issue an order in writing to any person to so attend.
- The search shall be made in the presence of such persons, and a list of things seized shall be prepared and signed by the witnesses.
- No female shall be searched by anyone except a female.
