Section 151B. Reciprocal Arrangement for Exchange of Information Facilitating Trade – Customs Act, 1962

151B. Reciprocal arrangement for exchange of information facilitating trade

  1. The Central Government may, by notification, direct that provisions of this Act relating to exchange of information shall apply to a country with which reciprocal arrangements have been made, subject to conditions/restrictions/exceptions specified in the notification, for facilitating trade between that country and India.
  2. The Central Government may, for facilitating trade, by notification, enter into an agreement/arrangement with a country outside India for: (a) exchange of information for verification of compliance in identified cases; (b) exchange of information for prevention/detection of duty evasion or countering smuggling of goods; (c) recovery of duty; (d) mutual assistance; and (e) other measures required for such facilitation.
  3. The information received under such an arrangement is deemed confidential and used only for the purposes of verification/compliance under the agreement/arrangement.
