Section 58B. Cancellation of Licence – Customs Act, 1962

58B. Cancellation of licence

  1. A licence granted under section 57, 58 or 58A may be cancelled by the Principal Commissioner/Commissioner of Customs: (a) on contravention of any provision of this Act, the rules or regulations, or breach of a licence condition, after a reasonable opportunity of being heard; or (b) on the licensee’s own request.
  2. Where a licence is cancelled, or expires and is not renewed, goods deposited in the warehouse shall, within ninety days (or such extended period as the officer allows), be removed to another warehouse or cleared for home consumption or export; if not so removed, section 72 applies as if the goods had not been removed within the permitted warehousing period.
