Section 11. Medical examination
(1) Where an employee has given notice of an accident, he shall, if the employer, before the expiry of three days from service of the notice, offers to have him examined free of charge by a qualified medical practitioner, submit himself for examination; and any employee receiving a half-monthly payment shall, if so required, submit himself for examination from time to time, subject to rules on frequency.
(2) If an employee refuses to submit himself for examination when required by the employer or the Commissioner, or obstructs the same, his right to compensation shall be suspended during the continuance of such refusal or obstruction, unless he was prevented by sufficient cause.
(3) If an employee, before expiry of the period within which he may be required to submit for examination, voluntarily leaves the vicinity of his place of employment without having been examined, his right to compensation is suspended until he returns and offers himself for examination.
(4) Where an employee whose right to compensation has been suspended under sub-section (2) or (3) dies without having submitted himself for medical examination, the Commissioner may, if he thinks fit, direct payment of compensation to the dependants of the deceased employee.
(5) No compensation shall be payable in respect of the period of suspension; if suspension commences before expiry of the waiting period under section 4(1)(d), that waiting period is extended by the period of suspension.
(6) Where an injured employee has refused free medical attendance offered by the employer, or having accepted it has deliberately disregarded the practitioner’s instructions, and it is proved this was unreasonable and the injury was thereby aggravated, the injury and resulting disablement shall be deemed of the same nature and duration as might reasonably have been expected had he been properly attended and followed instructions, and compensation shall be payable accordingly.
