Section 34. Emergency prohibition notices and orders

If the Designated Officer is satisfied that a health risk condition exists with respect to a food business, he may, after serving an emergency prohibition notice, apply to the Commissioner of Food Safety for an emergency prohibition order, giving the operator at least one day’s prior notice of the application. The Commissioner shall impose the prohibition if satisfied that the health risk condition exists.

A copy of the order must be served on the operator and affixed at the premises; knowing contravention is punishable with imprisonment up to two years and fine up to two lakh rupees. The order ceases to have effect once the Designated Officer certifies, within seven days of an application, that sufficient corrective measures have been taken, failing which he must give reasons within ten days.
