Section 40. Purchaser may have food analysed

A purchaser other than a Food Safety Officer may have any article of food analysed by the Food Analyst on payment of fees, after informing the food business operator at the time of purchase, and is entitled to a refund of the fee if the analysis shows non-compliance. Where the Food Analyst finds the sample in contravention of the Act, the report is forwarded to the Designated Officer to follow the prosecution procedure under section 42.
