Section 48. General provisions relating to offences
A person may render food injurious to health by adding any article or substance to it, using an article or substance as an ingredient, abstracting any constituent, or subjecting it to any other process or treatment, knowing it may be sold or distributed for human consumption.
In determining whether food is unsafe or injurious to health, regard must be had to the normal conditions of its use and handling, the information available to the consumer including on the label, the probable immediate and long-term and cumulative toxic effects, the sensitivities of the category of consumers for whom the food is intended, and the probable cumulative effect of ordinary consumption. Primary food that falls below the specified standard or limits of variability solely due to natural causes beyond human control is not deemed unsafe, sub-standard, or containing extraneous matter.
