Section 53. Penalty for misleading advertisement

A person who publishes, or is party to publishing, an advertisement that falsely describes any food, or is likely to mislead as to its nature, substance or quality or gives a false guarantee, is liable to a penalty of up to ten lakh rupees. In any proceeding, the fact that a label or advertisement contained an accurate statement of composition does not preclude a finding that the contravention was committed.
