Section 73. Power of court to try cases summarily
Notwithstanding the Code of Criminal Procedure, 1973, all offences not triable by a Special Court shall be tried summarily by a Judicial Magistrate of the first class or a Metropolitan Magistrate, with Sections 262 to 265 of that Code applying as far as may be.
On conviction in a summary trial, the Magistrate may pass a sentence of imprisonment not exceeding one year. Where it appears that a sentence exceeding one year may be warranted, or that summary trial is otherwise undesirable, the Magistrate shall, after hearing the parties, record an order to that effect, recall any witness already examined, and proceed to hear or rehear the case in the ordinary manner.
