Section 78. Power of court to implead manufacturer, etc.
Where, during trial of an offence alleged against a person who is not the importer, manufacturer, distributor or dealer of the article of food concerned, the court is satisfied on the evidence that such importer, manufacturer, distributor or dealer is also concerned with the offence, the court may proceed against them as though a prosecution had been instituted under this Act, notwithstanding Section 319(3) of the Code of Criminal Procedure, 1973, or Section 71 of this Act.
