Section 91. Power of Central Government to make rules
The Central Government may, by notification in the Official Gazette, make rules for carrying out the provisions of this Act.
Such rules may in particular cover matters including the salary, terms of service and oath of office of the Chairperson and Members of the Food Authority; the qualifications of Food Safety Officers and Food Analysts; the manner of taking extracts of documents seized under section 38; the determination of cases for referral to courts and the applicable time-frame under section 42; the procedure for adjudication of cases under section 68; the qualifications, terms of office, resignation and removal of the Tribunal’s Presiding Officer and the procedure and powers of the Tribunal; the fee payable for an appeal to the High Court under section 76; the form and timing of the Food Authority’s budget, accounts and annual report; and any other matter required or permitted to be prescribed by the Central Government.
