Section 94. Power of State Government to make rules

Subject to the rule and regulation-making powers of the Central Government and the Food Authority, a State Government may, after previous publication and with the previous approval of the Food Authority, by notification in the Official Gazette, make rules to carry out the functions and duties assigned to the State Government and the State Commissioner of Food Safety under this Act and the rules and regulations made thereunder.

Such rules may in particular cover other functions of the Commissioner of Food Safety under section 30(2)(f); the earmarking of a fund and the manner of paying rewards to persons rendering assistance in the detection of an offence or apprehension of an offender under section 95; and any other matter required or permitted to be prescribed by the State Government.

Every rule made by a State Government under this Act must be laid, as soon as may be after it is made, before each House of the State Legislature where it consists of two Houses, or before that House where the Legislature consists of one House.
