Section 97. Repeal and savings

With effect from a date appointed by the Central Government, the enactments and Orders specified in the Second Schedule stand repealed. Such repeal does not affect the previous operation of those enactments and Orders, or anything duly done or suffered thereunder; any right, privilege, obligation or liability already acquired, accrued or incurred under them; or any penalty, forfeiture or punishment incurred for offences committed against them — and any related investigation, legal proceeding or remedy may continue to be instituted, continued or enforced, and any such penalty, forfeiture or punishment may be imposed, as if this Act had not been passed.

Any other law for the time being in force in a State that corresponds to this Act stands repealed upon the commencement of this Act, and section 6 of the General Clauses Act, 1897 applies as if that State law had been repealed.

Notwithstanding the repeal, licences issued under the repealed enactments or Orders that are in force on the date this Act commences continue in force until their expiry, as if issued under this Act or the rules and regulations made thereunder.

Notwithstanding anything in any other law for the time being in force, no court shall take cognizance of an offence under the repealed Act or Orders after the expiry of three years from the date this Act commences.
