Section 19. Effect of removal from register for failure to pay fee for renewal
Even after a geographical indication has been removed for non-renewal, it continues, for one year after removal, to be treated as though still on the register for the purpose of assessing a fresh application to register another (possibly conflicting) indication — unless the Registrar or High Court is satisfied either that there was no genuine trade use of the removed indication in the two years before its removal, or that no deception or confusion is likely to arise from allowing the new registration given the previous use of the removed one.
