Section 25 – Geographical Indications Act: Prohibition of Registration of Geographical Indication as Trade Mark

The Geographical Indications of Goods (Registration and Protection) Act, 1999 — back to Table of Contents

Section 25. Prohibition of registration of geographical indication as trade mark

Notwithstanding the Trade Marks Act, 1999, the Registrar of Trade Marks must refuse or invalidate a trade mark — either on its own initiative or on request — where the mark contains or consists of a geographical indication for goods not originating from the place it indicates, if that use would confuse or mislead as to the true place of origin.

The same applies where the mark contains or consists of a geographical indication identifying goods notified for higher protection under section 22(2), regardless of confusion.
