The Geographical Indications of Goods (Registration and Protection) Act, 1999 — back to Table of Contents
Section 30. Adaptation of entries in register to amend or substitute classification of goods
When the classification of goods used for registration purposes changes, the Registrar generally cannot amend the register in a way that adds goods or classes beyond what was covered immediately before, or that backdates a registration to cover goods it did not previously include — unless satisfied that strict compliance would be unduly complex and that the change would not affect a substantial quantity of goods or prejudice anyone’s rights.
A proposed amendment of this kind must be notified to the registered proprietor and every affected authorised user, and advertised; it may be opposed by any aggrieved person on the ground that it exceeds these limits.
