Section 35. Appearance of Registrar in legal proceedings
The Registrar has the right to appear and be heard in High Court proceedings seeking alteration or rectification of the register, or raising questions about Registry practice, and in appeals arising from unopposed applications the Registrar refused or conditionally accepted, or opposed applications where appearance serves the public interest — and must appear if so directed.
Unless the High Court directs otherwise, the Registrar may, instead of appearing personally, submit a signed written statement giving relevant particulars of the proceedings, the grounds of any decision, Registry practice in similar cases, or other matters within the Registrar’s knowledge — which then stands as evidence in the proceeding.
