Section 37B. Appeal
A person aggrieved by an order of the adjudicating officer under section 37A may appeal to an appellate authority — an officer at least one rank senior to the adjudicating officer, notified by the Central Government — within sixty days of receiving the order, in the prescribed form and manner. A delayed appeal may still be admitted if sufficient cause is shown, and no appeal may be disposed of without giving the appellant a reasonable hearing. The appellate authority must dispose of the appeal within sixty days of filing.
Failure to comply with the adjudicating officer’s order, or the appellate authority’s order, within ninety days attracts a further fine of one lakh rupees, imprisonment up to one year, or both, in addition to the original penalty.
