Section 41. Enhanced penalty on second or subsequent conviction

A person previously convicted under section 39 or 40 who is convicted again of a similar offence faces enhanced punishment: imprisonment of one to three years and a fine of one lakh to two lakh rupees for the second and every subsequent offence, though courts may again reduce this for adequate and special reasons recorded in the judgment.

Convictions predating this Act’s commencement are not counted for this enhancement.
