Section 47. Exemption of certain persons employed in ordinary course of business
A person accused under section 39 is acquitted if they prove they are ordinarily employed by others to apply geographical indications, or to make dies, blocks, machines, plates or similar instruments used for that purpose; that they were so employed in the transaction charged and had no profit- or commission-based interest in the goods; that they had taken all reasonable precautions and had no reason at the time to suspect the geographical indication’s genuineness; and that, on demand by or for the prosecution, they gave all information in their power about the person on whose behalf the geographical indication was applied.
