Section 66. Suit for infringement, etc., to be instituted before district court

No suit for infringement of a registered geographical indication, relating to any right in one, or for passing off arising from the defendant’s use of an identical or deceptively similar geographical indication (registered or not) may be filed in any court below a district court with jurisdiction to try it.

For infringement and rights-related suits, a “district court having jurisdiction” includes, notwithstanding the Code of Civil Procedure or any other law, a district court within whose local limits the person instituting the suit (or any of them, if more than one) actually and voluntarily resides, carries on business, or personally works for gain at the time of institution. “Person” here includes the registered proprietor and the authorised user.
