Section 71. Power to require goods to show indication of origin
By notification, the Central Government may require that specified classes of goods — whether made or produced abroad and imported into India, or made or produced within India — carry, from a date at least three months after the notification’s issue, an indication of the country or place where they were made or produced, or the name and address of the manufacturer or the person for whom they were manufactured.
The notification may specify how the indication must be applied (to the goods themselves or otherwise) and when its presence is required (on importation only, or also at wholesale or retail sale). Such a notification can only issue on application by persons or associations substantially representing the interests of the dealers, manufacturers, producers, or users concerned, or where the Central Government is otherwise convinced it is necessary in the public interest, after whatever inquiry it considers necessary. Section 23 of the General Clauses Act, 1897 (on previous publication) applies to such notifications.
A notification under this section does not apply to imported goods that the Commissioner of Customs is satisfied, at the time of importation, are intended for export (whether after transhipment in or transit through India, or otherwise).
