Section 72. Certificate of validity
Where, in contested rectification proceedings before the High Court, a decision on the validity of a registration is given in favour of the registered proprietor or authorised user, the High Court may grant a certificate of validity. If such a certificate is granted, then in any subsequent proceeding where that validity is again in question, the proprietor or authorised user, on obtaining a final order or judgment affirming validity, is entitled — unless that order or judgment directs otherwise for sufficient reason — to full costs, charges, and expenses as between legal practitioner and client.
