Section 84. Special provisions relating to applications for registration from citizens of convention countries
To fulfil a treaty, convention, or arrangement with a country (or a group or union of countries, or an inter-governmental organisation) outside India that grants Indian citizens privileges similar to its own, the Central Government may, by notification, declare it a convention country for this Act’s purposes.
Neither this Act nor the Trade Marks Act, 1999 prevents the continued, similar use of a geographical indication relating to a notified convention country identifying wines or spirits, by a citizen or domiciliary of that country who has used it continuously with regard to those goods (or related goods) anywhere in that country’s territory, either for at least ten years before 15 April 1994, or in good faith before that date.
