Section 23. [Special provision respecting dwelling-houses.] — Omitted.

Section 23 originally imposed a restriction on a female heir’s right to claim partition of a dwelling-house wholly occupied by members of the intestate’s family until the male heirs chose to divide their shares, and barred her from claiming partition of the house at all unless she was residing there, though she was entitled to a right of residence. This section was omitted by the Hindu Succession (Amendment) Act, 2005 (39 of 2005), section 4, with effect from 9 September 2005, removing this restriction and placing female heirs on an equal footing with male heirs in respect of the dwelling-house.
