Section 12 – Motor Vehicles Act, 1988

12. Licensing and regulation of schools or establishments for imparting instruction in driving of motor vehicles.

(1) The Central Government may make rules for the purpose of licensing and regulating, by the State Governments, schools or establishments (by whatever name called) for imparting instruction in driving of motor vehicles.

(2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:— (a) the minimum educational qualification, minimum experience, syllabus of theoretical and practical instructions, physical fitness and training required for grant of licence to schools or establishments referred to in sub-section (1); (b) the boarding, lodging, laboratory and other facilities to be provided in such schools or establishments; (c) the number of and qualifications of instructors employed in such schools or establishments; (d) the type of motor vehicles fitted with dual control and other equipments to be used for imparting driving instructions; (e) the syllabus and duration of the training and the manner in which practical and theoretical tests shall be conducted by the schools or establishments for the purpose of assessing the competence to drive of the trained persons; (f) the qualifications required for enrolment of a person for grant of driving certificate, the manner of holding examination for assessing the competency of instructors and the periodic inspection of such schools or establishments; (g) the maintenance of records by the schools or establishments and awards of certificate on successful completion of training; (h) the fee which may be charged for imparting training and any other matter relating thereto; (i) the security to be deposited as may be prescribed for grant of licence; (j) any other matter which may be prescribed.

(3) Where the Central Government is satisfied that it is necessary or expedient so to do, it may, by rules made in this behalf, exempt generally, either absolutely or subject to such conditions as may be specified therein, any category of schools or establishments referred to in sub-section (1) from the operation of all or any of the provisions of this section or any rule made thereunder.
