Section 13. Jurisdiction of Special Courts
(1) Notwithstanding anything contained in the Code, every Scheduled Offence investigated by the Agency shall be tried only by the Special Court within whose local jurisdiction it was committed.
(2) If, in the course of an investigation into any Scheduled Offence, it appears to the officer investigating the offence that the offence has been committed at more places than one, or if, having regard to the exigencies of the situation prevailing in a State or States, trial of the offence in the Special Court in that State is not feasible and it is expedient to try the offence at any other place in that State or in another State, the Agency may file the charge sheet before the Special Court having jurisdiction and the Central Government shall constitute a Special Court, at the place as it may deem fit and if such Special Court is constituted in another State, subject to the provisions of the Constitution, the transfer of the case to that Special Court shall be made by the Supreme Court, as the case may be, on an application made to it by the Central Government.
(3) The Attorney-General for India or a Special Public Prosecutor appointed under section 15 or an officer authorised by the Agency, as the case may be, may make an application for transfer of a case under sub-section (2).
