Section 107A – Patents Act, 1970

107A. Certain acts not to be considered as infringement

The following are not infringement of patent rights: (a) making, constructing, using, selling or importing a patented invention solely for uses reasonably related to developing and submitting information required under any Indian or foreign law that regulates manufacture, construction, use, sale or import of a product (the “Bolar” exemption); and (b) importation of patented products by any person from someone duly authorised under law to produce and sell or distribute the product (parallel imports).
