110. Right of licensee under section 84 to take proceedings against infringement

A compulsory licensee under section 84 may call upon the patentee to prevent infringement; if the patentee refuses or neglects within two months, the licensee may sue in his own name as if he were the patentee, making the patentee a defendant. The patentee, if so added, is not liable for costs unless he appears and takes part.
