Section 137 – Patents Act, 1970

137. Multiple priorities

(1) Where two or more applications for related inventions constituting one invention were filed in one or more convention countries, a single Indian application may be made within twelve months of the earliest, covering the inventions disclosed in the basic applications’ specifications.

(2) The priority date of a claim based on matter disclosed in one or more basic applications is the date that matter was first disclosed.

(3) Matter is deemed disclosed in a basic application if claimed or disclosed (other than by disclaimer or acknowledgment of prior art) in that application or supporting documents filed at the same time, provided a copy of such document is filed at the patent office with the convention application or within the prescribed period thereafter.
