146. Power of Controller to call for information from patentees

(1) The Controller may, during the patent’s continuance, require by written notice a patentee or licensee to furnish, within two months (or such further time as allowed), information or periodical statements on the extent to which the patented invention has been commercially worked in India.

(2) Every patentee and licensee must in any case furnish, in the prescribed manner and form and at intervals of not less than six months, statements on the extent of commercial working in India.

(3) The Controller may publish the information received under sub-sections (1) or (2) in the prescribed manner.
