28. Mention of inventor as such in patent
(1) If the Controller is satisfied that the person named is the inventor (or of a substantial part) of the invention and that the application is a direct consequence of his being the inventor, the Controller shall cause him to be mentioned as inventor in the patent and in the register:
Provided that mention as inventor does not confer or derogate from any rights under the patent.
(2) A request to mention a person as inventor may be made by the applicant or, where the person alleged to be inventor is not the applicant, jointly by the applicant and that person.
(3) A person not covered by a request under sub-section (2) who desires to be mentioned may make a claim in the prescribed manner.
(4) A request or claim under this section shall be made before the grant of patent.
(6) Where a claim is made under sub-section (3), the Controller shall notify every applicant (other than the claimant) and any other interested person, and shall, if required, hear the parties before deciding on any request or claim under sub-section (2) or (3).
(7) Where a person has been mentioned as inventor, any other person alleging that he ought not to have been so mentioned may apply to the Controller for a certificate to that effect; the Controller may, after hearing interested persons, issue such certificate and rectify the specification and register accordingly.
