60. Applications for restoration of lapsed patents
(1) Where a patent has ceased to have effect due to failure to pay a renewal fee within the period prescribed under section 53 (or any extended period allowed under section 142(4)), the patentee or his legal representative (or, where held jointly, one or more joint holders with the Controller’s leave) may, within eighteen months from the date the patent ceased to have effect, apply for restoration.
(3) The application shall contain a statement, verified in the prescribed manner, fully setting out the circumstances leading to the failure to pay the fee, and the Controller may require further evidence as he thinks necessary.
