Section 36B. Disposal of disciplinary proceedings

(1) A State Bar Council’s disciplinary committee must dispose of a complaint under section 35 within one year of receipt (or of initiation, if Council-initiated); failing which, the proceeding stands transferred to the Bar Council of India, to be disposed of as if withdrawn for inquiry under section 36(2).

(2) For proceedings pending at the commencement of the Advocates (Amendment) Act, 1973, the State Bar Council’s disciplinary committee must dispose of them within six months of that commencement, or within one year of the complaint/initiation date, whichever is later — failing which they similarly transfer to the Bar Council of India.
