Section 38. Appeal to the Supreme Court
Any person aggrieved by an order of the Bar Council of India’s disciplinary committee under section 36 or 37 (or the Attorney-General of India, or the Advocate-General of the State concerned) may, within sixty days of communication of the order, appeal to the Supreme Court, which may pass such order (including varying the punishment) as it deems fit.
Proviso: No order shall be varied so as to prejudicially affect the aggrieved person without giving him a reasonable opportunity of being heard.
