Section 49A. Power of Central Government to make rules
(1) The Central Government may, by Gazette notification, make rules to carry out the purposes of this Act, including on any matter for which the Bar Council of India or a State Bar Council has power to make rules.
(2) Such rules may provide for: (a) qualifications/disqualifications for Bar Council membership; (b) manner of Bar Council of India’s supervision and control over State Bar Councils; (c) class/category of persons entitled to be enrolled as advocates; (d) categories exempted from training/examination under section 24(1)(d); (e) manner of determining seniority; (f) procedure for disciplinary committees; (g) any other prescribed matter.
(3) Rules under this section may be made for the whole of India or for all or any Bar Councils.
(4) Where a Central Government rule conflicts with a Bar Council rule, the Central Government rule prevails to the extent of the repugnancy.
(5) Every rule made under this section is laid before each House of Parliament for thirty days, subject to modification or annulment.
