Advocates Act, 1961 — back to Table of Contents

Section 60. Power of Central Government to make rules

(1) Until a State Bar Council makes rules on a matter under this Act and they are approved by the Bar Council of India, the Central Government may exercise the rule-making power for that matter.

(2) The Central Government, after consulting the Bar Council of India, may by Gazette notification make such rules for any State Bar Council or generally for all State Bar Councils; these have effect notwithstanding anything else in this Act.

(3) Where the Central Government has made rules for a State Bar Council on a matter, and the State Bar Council subsequently makes and gets approved its own rules on the same matter, the Central Government may, by notification, direct that its own rules cease to apply to that Bar Council from a specified date — except as respects things already done under them.

Note: Inserted by Act 32 of 1962, with effect from 14 September 1962. This is the final substantive section of the Act.
